THE City of Brookside Village intends to engage a Contractor to exclusively collect, legally
dispose and process solid waste, bulky and brush waste, with an individual option of recyclable
materials from all single-family homes (Customer) and City facilities. All single-family homes have
mandatory inclusion and shall be charged as described for services provided in the contract.
Commercial and industrial customers are not included in this contract but may have the option to
become a Customer if they so choose. Commercial customers may choose any private firm for the
collection, transportation, processing, and/or disposal of solid waste and recyclable materials
that best meets their budgetary restrictions.
The Contractor will be responsible for:
β’ Providing both efficient and economical residential curbside, solid waste collection and legal
disposal two times per week and assisting in the transfer from non-exclusive trash collection
service to exclusive.
β’ Provide both efficient and economical residential curbside recycling collection for sale in
marketable products once per week on the same day as one of the two designated trash collection
days.
β’ Maximize sanitary and esthetic living conditions for the citizens of the City of Brookside
Village.
β’ Maintain positive communications with the City and the Customers.

1.1 Legal Authority
The City of Brookside Village has the authority under Texas Health and Safety Code Sections
363.116 and 363.117 to enter into contracts to enable it to furnish or receive solid waste
management services on the terms considered appropriate by the public agencyβs governing body.
Further, Section 364.034 allows the City of Brookside to enforce its grant of a franchise or
contract for solid waste collection and transportation services within its territory except that
the City may not restrict the right of an entity to contract with a licensed waste hauler for the
collection and removal of domestic septage or of grease trap waste, grit trap waste, lint trap
waste, or sand trap waste.
