Business Profile Claim Terms

These Business Profile Claim Terms ("Claim Terms") supplement and are incorporated into the Zabalist Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

1. Profile Claiming Overview

Zabalist maintains a directory of construction industry professionals derived from public government records. Profile claiming allows authorized representatives to:

• Verify and enhance their business listing
• Add contact information, logos, and descriptions
• Receive and respond to lead inquiries
• Display verification badges
• Access analytics and insights

2. Eligibility & Authorization

2.1 Who May Claim a Profile

You may only claim a profile if you are:

• The owner or principal of the business
• An authorized officer, director, or manager
• An employee expressly authorized by the business owner to manage the profile
• A marketing agency with written authorization from the business

2.2 One Claim Per Entity

Each business entity may be claimed by only one account. If multiple people need access, the primary claimant may grant team access (where available) or transfer the claim.

2.3 Authorization Representation

By claiming a profile, you represent and warrant that you have the legal authority to act on behalf of the business and that all information you provide is accurate and authorized.

3. Verification Process

3.1 Verification Methods

We may verify your authorization through one or more methods:

• Email verification: Confirming access to a company domain email
• Phone verification: Calling a publicly listed business number
• Document verification: Reviewing business licenses, registration documents, or authorization letters
• LinkedIn/public records: Cross-referencing your identity with public information

3.2 Verification Timeline

We aim to complete verification within 3-5 business days. Complex cases may take longer. We may request additional information if needed.

3.3 Denial of Claims

We reserve the right to deny a claim if we cannot verify your authorization, if the information provided is false or misleading, or for any other reason at our sole discretion. Denied claims are non-refundable unless the denial is due to our error.

4. Profile Content & Accuracy

4.1 Accurate Information

You agree to provide and maintain accurate, current, and complete information including:

• Legal business name
• Correct business address and service areas
• Valid contact information
• Accurate license and certification numbers
• Truthful descriptions of services and capabilities

4.2 Prohibited Content

Profile content must not:

• Contain false, misleading, or deceptive statements
• Infringe on third-party intellectual property rights
• Include offensive, discriminatory, or illegal content
• Misrepresent licenses, certifications, or qualifications
• Include fake reviews or testimonials
• Contain malware, phishing links, or harmful code

4.3 Profile Editing Rights

We reserve the right to edit, remove, or flag content that violates these terms or our guidelines, without prior notice. We may add labels or disclaimers to profiles as needed.

5. Data Source Integration

5.1 Source Data

Business profiles on Zabalist are derived from multiple publicly available sources including:

• Government public records (TDLR registrations, building permits, municipal records)
• Federal databases (SAM.gov, SBA registries)
• Publicly accessible trade association directories and industry listings
• Construction project databases and professional registries
• Other publicly available business information sources

Data from these sources will continue to appear on your profile. Information from official government sources generally cannot be removed as it serves the public interest.

5.2 Corrections to Source Data

If data on your profile from government sources is incorrect, you must correct it at the original source agency (e.g., TDLR, city permit office). Once corrected at the source, updates will sync to Zabalist during our regular data refresh cycles.

For data from other publicly accessible sources, you may request corrections or removal by contacting us with supporting documentation.

5.3 Supplemental Information

Claimed profiles may add supplemental information (logo, enhanced description, additional contact info, photos, certifications) that goes beyond source data. This supplemental content is distinguished from automatically aggregated source data.

6. Subscription & Payment

6.1 Claim Subscription

Profile claiming requires a paid subscription. Pricing is displayed during the claim process and may vary based on features and profile type.

6.2 Billing

Subscriptions are billed monthly or annually in advance. Subscriptions automatically renew unless cancelled. See our general Terms of Service for complete billing terms.

6.3 Refunds

Claim subscriptions are non-refundable except:

• If we deny your claim due to our error
• As required by applicable law
• At our sole discretion in extraordinary circumstances

7. Lead Generation & Inquiries

7.1 Contact Forms

Claimed profiles may receive inquiries through our platform. You agree to respond to inquiries professionally and in compliance with all applicable laws.

7.2 Lead Quality

We do not guarantee the quality, quantity, or conversion rate of leads. Lead volume depends on many factors including your profile completeness, market conditions, and user behavior.

7.3 Communication Standards

When responding to leads, you must:

• Identify yourself and your company clearly
• Provide accurate information about services and pricing
• Comply with all advertising and consumer protection laws
• Respect user privacy and communication preferences

8. Profile Disputes

8.1 Competing Claims

If someone else claims a profile you believe belongs to your business, contact us immediately at claims@zabalist.com. We will investigate and may require documentation from both parties.

8.2 Dispute Resolution

We are not obligated to resolve disputes between parties claiming the same profile but may do so at our discretion. Our decision is final. We may suspend a profile during investigation.

8.3 Fraudulent Claims

Fraudulently claiming a profile you are not authorized to manage is a serious violation. We may:

• Immediately terminate your account
• Reverse all profile changes
• Report fraudulent activity to law enforcement
• Pursue legal remedies including damages

9. Transfer of Claims

Profile claims may be transferred to a new owner in connection with a bona fide sale or transfer of the underlying business. Contact us to initiate a transfer. We require documentation of the business transfer.

10. Termination & Suspension

10.1 By You

You may cancel your claim subscription at any time through your dashboard. Cancellation takes effect at the end of the billing period. Your enhanced profile content will be removed, but public record data remains.

10.2 By Us

We may suspend or terminate your claimed profile if:

• You violate these Claim Terms or our Terms of Service
• We determine you are not authorized to manage the profile
• Your payment method fails and is not resolved
• The underlying business closes or loses its licenses
• We receive valid legal or regulatory demands

10.3 Effect of Termination

Upon termination, your enhanced profile content (logo, description, added contact info) will be removed. The underlying public record profile will remain visible on Zabalist.

11. Indemnification

In addition to the indemnification obligations in our Terms of Service, you specifically agree to indemnify us against any claims arising from:

• Your profile content or business practices
• Disputes with customers or leads from the platform
• Allegations of unauthorized profile claiming
• Misrepresentations of licenses or qualifications
