DMCA Copyright Policy

Smart Austin LLC d/b/a Moon Sherpa Labs ("Company") respects the intellectual property rights of others and expects users of Zabalist to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our Services.
2. Nature of Our Data
Zabalist aggregates and displays publicly available government records, including but not limited to:
- Building permit applications and approvals from municipal governments
- Construction project registrations from the Texas Department of Licensing and Regulation (TDLR)
- Site plan development cases from the City of Austin
- Business registration information from public databases
- SBA certification data from SAM.gov
Public records are generally not subject to copyright protection. Government-created documents and factual data contained in public records are typically in the public domain. We aggregate this publicly available information to provide a valuable research and business intelligence service.
3. What This Policy Covers
This DMCA policy applies to:
- User-submitted content (such as business profile descriptions, logos, and photos uploaded by profile claimants)
- Original content created by Zabalist (articles, analysis, design elements)
- Any other copyrightable material on the Services
This policy does not generally apply to the display of public government records, which are factual information not protected by copyright.
4. Filing a DMCA Takedown Notice
If you believe that copyrighted material has been posted on our Services without authorization, you may submit a DMCA takedown notice to our designated agent. Your notice must include:
- Identification of the copyrighted work you claim has been infringed
- Identification of the material you claim is infringing, including the URL or other specific location
- Your contact information (name, address, phone number, email)
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
- Your physical or electronic signature

Important: Misrepresentations in a DMCA notice may result in liability for damages, including costs and attorneys' fees. Consult an attorney before filing a notice if you are unsure whether material infringes your copyright.
6. Counter-Notification
If you believe material was removed in error, you may file a counter-notification. Your counter-notice must include:
- Your physical or electronic signature
- Identification of the material removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, phone number, and email
- A statement that you consent to the jurisdiction of the federal court in Travis County, Texas, and that you will accept service of process from the complainant
Upon receiving a valid counter-notification, we will provide a copy to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the material.
7. Repeat Infringers
In accordance with the DMCA, we will terminate the accounts of users who are repeat infringers in appropriate circumstances.
8. Good Faith Disputes Regarding Public Records
If you believe information displayed from public records is inaccurate (but not a copyright issue), please contact us at corrections@zabalist.com. We will investigate and update records where appropriate. Note that we cannot remove accurate public record information, as it is sourced from government databases.
9. Business Profile Disputes
If you believe someone has falsely claimed your business profile or uploaded unauthorized content to a profile:
- Contact us at support@zabalist.com
- Provide proof of business ownership
- We will investigate and take appropriate action
10. Modifications
We reserve the right to modify this DMCA Policy at any time. Changes will be posted on this page with an updated effective date.
