Admiral Nimitz Foundation Operating Agreement (ANF) and THC

This Operating Agreement supersedes all other agreements between the Texas Historical Commission ("THC") and the Admiral Nimitz Foundation ("ANF") for the operation of the National Museum of the Pacific War and will become effective as of January 1, 2024 ("Effective Date"). WHEREAS, pursuant to an act of the Legislature of the State of Texas, passed as House Bill 2025 in the 79th regular session and signed into law by the Governor of the State of Texas on June 18, 2005, amending Chapter 442 of the Texas Government Code (the "Act"), THC acquired and now owns The National Museum of the Pacific War in Fredericksburg, Texas (including the properties known as the Admiral Nimitz Museum, the George H.W. Bush Gallery, the Nimitz Education and Research Center, the Pacific Combat Zone, the Japanese Garden of Peace, the Memorial Courtyard and the Plaza of the Presidents, all of which are jointly referred to as the "Museum"); and WHEREAS, pursuant to the Act, THC is authorized to enter into an agreement with ANF for the expansion, renovation, management, operation, and financial support of the Museum; and WHEREAS, THC and ANF desire to set forth their respective expectations, rights, responsibilities and obligations with respect to the operation of the Museum in the Operating Agreement, effective November 1, 2005.
